1. Description of Service

Fontify provides an automated software tool that allows users to upload an image containing text or lettering and generates a downloadable font file based on the visual characteristics of that uploaded image.

2. User Content and Intellectual Property Rights

a. Your Ownership and Responsibilities

You retain all ownership rights to the images you upload. However, by uploading an image to Fontify, you represent and warrant that:

• You are the original creator of the uploaded image, or you have obtained all necessary rights, licenses, consents, and permissions to use and modify the image.
• The uploaded image does not infringe upon the copyright, trademark, trade dress, or any other intellectual property rights of any third party (e.g., uploading a famous brand logo or an existing commercial font to duplicate it).
• Your use of the resulting generated font will not violate any applicable laws or third-party rights.

b. Prohibited Content

You explicitly agree not to upload any materials that are protected by copyright or trademark without the express written consent of the rights holder. Fontify reserves the right, but has no obligation, to review, reject, or delete any uploaded image or generated font that it suspects violates these Terms.

3. Privacy and Data Handling

Fontify acts purely as a processing pipeline. When you upload an image, it is temporarily held in active memory solely for the duration required to generate the font mathematically. We do not permanently store your uploaded images, nor do we use your uploads to train any underlying AI models. Once the font generation is complete, the original reference data is discarded. We only retain the mathematical font parameters required to serve the downloadable .ttf file to you.

4. Indemnification (Your Liability)

You agree to defend, indemnify, and hold harmless Fontify, its founders, affiliates, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from:

• Your use of and access to the Service.
• Your violation of any term of these Terms.
• Your violation of any third-party right, including without limitation any copyright, property, or privacy right.
• Any claim that your uploaded content or the resulting generated font caused damage to a third party.

5. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Fontify be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or relating to the use of, or inability to use, the Service.

Fontify acts solely as an automated generation tool and assumes no responsibility or liability for the end-use of the fonts generated by our users. We do not monitor or verify the legal status of the uploaded images or the resulting fonts.

6. DMCA / Copyright Takedown Policy

Fontify respects the intellectual property rights of others. If you believe that your copyrighted work has been copied or used in a way that constitutes copyright infringement through our Service, please contact us at support@fontify.co with the following information:

• A description of the copyrighted work that you claim has been infringed.
• A description of where the allegedly infringing material is located on our site (if applicable).
• Your contact information.
• A statement by you, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

7. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. Fontify makes no representations or warranties of any kind, express or implied, regarding the accuracy, reliability, or functionality of the generated fonts. We do not guarantee that the generated fonts will be perfectly identical to the uploaded images or fit for any specific commercial or personal purpose.

8. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms (such as repeatedly attempting to pirate commercial fonts).
